GENERAL INFORMATION
Welcome to trujilloart.com. The terms “we”, “us” and “our” refer to TrujilloArt.
TrujilloArt operates this store and website, including all information, content, features, tools, products and related services made available to our customers (the “Services”). Shopify provides the technology that allows us to offer the Services.
The following terms and conditions, together with any policies referred to in this document, describe your rights and responsibilities when using the Services (the “Terms of Service” or the “Terms”).
Please read these Terms of Service carefully, as they contain important information about your rights and responsibilities, including purchase conditions, warranties, exclusions and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these Terms of Service or to our Privacy Policy, you must not use or access our Services.
SECTION 1 — ACCESS AND ACCOUNT
By accepting these Terms of Service, you represent that you are of the legal age required to enter into contracts in your place of residence and that you have consented to any minors under your responsibility using the Services on devices that you own, purchase or manage.
To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address and billing, payment and shipping details.
You represent and warrant that all information you provide to our store is accurate, current and complete, and that you have the right to provide such information.
You are solely responsible for maintaining the security of your account credentials and for all activity carried out through your account. You may not transfer, sell, assign or license your account to any other person.

We have made every effort to display our products and services accurately in our online store. However, the colours or appearance of an artwork may vary slightly from the image displayed on screen, depending on the device used and its settings.
These differences in representation do not affect the authenticity or essential characteristics of the artwork purchased.
Product descriptions, characteristics and availability may be changed at any time. We may also discontinue a product or limit the quantities available to any person, geographic region or jurisdiction.
These rights do not limit the consumer’s legal rights or any mandatory statutory warranties that may apply.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. TrujilloArt may accept or reject an order where there is a legitimate reason, such as lack of availability, an obvious error in the price or description, an inability to verify payment or a reasonable suspicion of fraud.
An order will be considered accepted when we send you an express confirmation after processing the relevant payment.
We recommend that you carefully review your order before completing your purchase. Once an order has been accepted, it may not always be possible to honour a cancellation request, without prejudice to your rights under our Returns and Refunds Policy and applicable law.
If we are unable to accept, amend or process your order, we will notify you using the email address, billing address or telephone number provided during the purchase.
Returns, exchanges and refunds are governed by our Returns and Refunds Policy.
When making a purchase, you confirm that the products are being purchased for personal or household use and not for resale or commercial export.
SECTION 4 — PRICES AND BILLING
Prices, discounts and promotions may change without notice. The price applicable to a product or service will be the price in effect when the order is placed and will appear in the purchase confirmation sent by email.
Applicable shipping costs will be shown during the checkout process. Import taxes, customs duties and any carrier handling fees applicable outside the European Union are the buyer’s responsibility, unless expressly stated otherwise.
Prices published in our online store may differ from prices offered in physical stores, through other sales channels or by third-party stores.
We may offer promotions subject to specific conditions that differ from these Terms. If there is a conflict between the conditions of a promotion and these Terms, the specific promotional conditions will prevail during the relevant promotional period.

You also agree to promptly update your account information, including your email address, payment details and applicable expiry dates, so that we can complete transactions and contact you when necessary.
You represent and warrant that:
- The payment information you provide is true, accurate and complete.
- You are authorised to use the payment method provided.
- The charges made will be accepted by your financial institution.
- You will pay all applicable amounts, including shipping costs, handling charges and applicable taxes.
SECTION 5 — SHIPPING AND DELIVERY
Delivery times are estimates and may vary due to circumstances involving the carrier, customs procedures, weather conditions, legal restrictions or other events beyond our reasonable control.
We do not guarantee an exact delivery date, but we will notify you when we become aware of a significant delay.
For consumer sales, the risk of loss or damage passes to the buyer when the buyer, or a third party designated by the buyer other than the carrier, physically takes possession of the product, unless applicable law provides otherwise.
Nothing in this section limits the consumer’s legal rights regarding delivery, product conformity or damage occurring during transport.
SECTION 6 — INTELLECTUAL PROPERTY
The Services, including trademarks, text, descriptions, images, graphics, reviews, videos, audio and the design, selection and arrangement of these elements, belong to TrujilloArt, its licensors or other rights holders, and are protected by applicable intellectual property laws.
These Terms allow you to use the Services solely for personal and non-commercial purposes.
You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit any material from the Services without our prior written consent.
The purchase of an artwork transfers ownership of the physical artwork, but does not transfer copyright or any reproduction, distribution or commercial exploitation rights.
Unless expressly stated otherwise, these Terms do not grant you any licence or other right to any patents, trademarks, copyrights or other intellectual property belonging to TrujilloArt, Shopify or third parties.
Unauthorised use of the Services may constitute an infringement of applicable law. All rights not expressly granted are reserved.
TrujilloArt names, logos, product and service names, designs and slogans may not be used without our prior written permission. Shopify names, logos and trademarks belong to Shopify. All other trademarks belong to their respective owners.
SECTION 7 — OPTIONAL TOOLS
We may provide access to third-party tools as part of the Services. We do not necessarily monitor or control these tools and do not participate in their operation.
Access to these tools is provided on an as-available basis and to the extent permitted by applicable law. We are not responsible for damage caused by their use where the damage is attributable to the relevant third-party provider.
You use optional tools at your own risk. Before using any third-party tool, you should review and accept the applicable terms of the relevant provider.
We may also introduce new features, tools and resources through the Services. These new features will be subject to these Terms unless expressly stated otherwise.

The Services may contain materials and links to websites provided or operated by third parties, including third-party embedded features.
We are not required to examine or evaluate the content, accuracy or practices of third-party websites or materials that you choose to access.
If you leave the Services to access a third-party website or material, you do so at your own risk.
We are not responsible for damage related to your access to third-party websites or your purchase or use of products, services, resources or content offered by third parties.
Please carefully review the policies and practices of the relevant third party before entering into any transaction. Complaints, claims, questions or concerns about third-party products and services should be directed to the relevant third party.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
TrujilloArt operates using Shopify technology, which allows us to provide the Services.
However, any sale or purchase made through our store takes place directly between you and TrujilloArt. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales made between you and TrujilloArt, including any injury, damage or loss resulting from the purchase of products or services.
To the extent permitted by applicable law, you expressly release Shopify and its affiliates from any claim, damage or liability arising from or relating to your purchase or transaction with TrujilloArt.
SECTION 10 — PRIVACY POLICY
All personal information we collect through the Services is processed in accordance with our Privacy Policy.
Certain personal information relating to your access to and use of the Services may also be processed by Shopify in accordance with Shopify’s privacy policy.
Because the Services are hosted by Shopify, Shopify may collect and process information relating to your access to and use of the store in order to provide, protect and improve the Services.
Information that you submit through the Services may be transmitted to and shared with Shopify and with providers located in other countries where necessary to provide the Services.

If you submit, upload, publish, email or otherwise transmit ideas, suggestions, comments, reviews, proposals, plans or other content, collectively referred to as “Comments”, you grant us a worldwide, non-exclusive, sublicensable, transferable and royalty-free licence to use, reproduce, modify, publish, distribute and display those Comments in any medium and for any purpose related to managing, providing, evaluating, improving, optimising or promoting the Services.
You represent and warrant that:
- You own or have all necessary rights to the Comments.
- You have disclosed any compensation or incentive received in connection with them.
- The Comments comply with these Terms and applicable law.
We are not required to keep Comments confidential, pay compensation for them or respond to them.
We may, but are not required to, monitor, edit or remove Comments that we consider unlawful, offensive, threatening, defamatory, pornographic, obscene, unacceptable or contrary to third-party intellectual property rights or these Terms.

You are solely responsible for the Comments you publish and for their accuracy. We are not responsible for Comments published by you or by third parties.

From time to time, information included in the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, offers, shipping charges, delivery times or availability.
We may correct errors, inaccuracies and omissions and update information when necessary. We may also cancel an order if there is a material or obvious error in the information published, even after receiving the order, always in accordance with applicable law.
Nothing in this section limits the consumer’s legal rights or TrujilloArt’s obligations regarding accepted orders.
SECTION 13 — PROHIBITED USES
You may access and use the Services only for lawful purposes. You may not access or use the Services, directly or indirectly:
a. For any unlawful, fraudulent or malicious purpose.
b. To breach any international, European, national, regional or local law, regulation or rule.
c. To infringe the intellectual property rights of TrujilloArt or any third party.
d. To harass, abuse, insult, threaten, defame, intimidate or harm any person.
e. To transmit false or misleading information.
f. To send, receive, upload, download, use or reuse materials that breach these Terms.
g. To transmit or arrange for the transmission of unsolicited advertising, spam, chain letters or similar requests.
h. To impersonate another person or entity.
i. To engage in conduct that restricts or prevents other people from using the Services, or that may cause damage or liability to TrujilloArt, Shopify or users.
You also agree not to:
a. Upload or transmit viruses or other malicious code.
b. Reproduce, duplicate, copy, extract, sell, resell or exploit any part of the Services.
c. Collect or track third-party personal information without authorisation.
d. Send spam, conduct phishing or participate in fraudulent or deceptive practices.
e. Use robots, web spiders, data-extraction tools, artificial intelligence systems or automated agents to access the Services without authorisation.
f. Interfere with, bypass or breach security, authentication, robot-exclusion headers or other access-control measures.
We may suspend, deactivate or cancel an account or access to the Services if we reasonably determine that these Terms have been breached, without prejudice to any legal rights that may apply to the user.

In addition, no Agent may access, use or interact with the Services if we have requested that it refrain from doing so.

Agents must:
i. Identify in every HTTP or HTTPS request that the request comes from an Agent and disclose its name using the following string in the user-agent field:

ii. Not conceal or misrepresent the fact that access, use or interaction comes from an Agent, including by:
a. Imitating human behaviour or human interaction patterns.
b. Completing or bypassing CAPTCHAs or other measures designed to distinguish computer use from human use.
iii. Answer truthfully any question or instruction intended to determine whether an interaction comes from a person or a computer.
iv. Not bypass or otherwise avoid any measure designed to block, limit, modify or control whether Agents access, use or interact with the Services, or how they do so.
SECTION 15 — TERMINATION
We may suspend or terminate your access to the Services, or to any part of them, where there is a legitimate reason and to the extent permitted by applicable law.
You remain responsible for any amounts owed up to the effective date of the suspension or termination.
The following sections will continue to apply after any termination or cancellation where, by their nature, they are intended to survive: Intellectual Property, Comments, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy and any other provisions that should continue to apply.

The information provided through the Services is for general informational purposes only. We aim to keep it accurate and up to date, but we do not guarantee that it is complete or suitable for any particular purpose.

Unless TrujilloArt expressly states otherwise, the Services and the products offered through them are provided on an as-available basis and to the extent permitted by applicable law.
We do not guarantee that use of the Services will be uninterrupted, timely, secure or error-free.
Nothing in this section excludes or limits statutory warranties, legal conformity rights or any other mandatory consumer protection.
Where the exclusion of implied warranties is limited or not permitted by applicable law, this section will apply only to the maximum extent permitted by that law.
SECTION 17 — LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, TrujilloArt and its collaborators, directors, employees, affiliates, agents, contractors, service providers and licensors, as well as Shopify and its affiliates, will not be liable for indirect, incidental, special or consequential losses or damages arising from the use of the Services or products purchased through them.
This may include, to the extent permitted by law, loss of profits, revenue, savings or data, replacement costs or other similar losses.
This limitation does not apply where liability cannot legally be excluded, including cases involving fraud, wilful misconduct, gross negligence, personal injury or breach of mandatory consumer rights.
SECTION 18 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless TrujilloArt, Shopify and their respective affiliates, officers, directors, employees, agents, contractors, licensors and service providers from losses, damages, liabilities or third-party claims, including reasonable legal fees, arising from:
- Your breach of these Terms or any policies incorporated by reference.
- Your violation of any law or third-party rights.
- Your unlawful or unauthorised use of the Services.
We will notify you of any claim that may give rise to an indemnification obligation where reasonably possible.
A delay in providing such notice will not release you from your obligations unless the delay causes you material prejudice.
We may control the defence and resolution of the claim, but we will not agree to any settlement that imposes non-monetary obligations on you without your reasonable consent.
This section does not apply to the extent that the claim results from unlawful or negligent conduct by TrujilloArt or relates to rights that a consumer cannot legally waive.
SECTION 19 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will remain enforceable to the maximum extent permitted by law, and the unenforceable part will be considered severed.
The invalidity or unenforceability of one provision will not affect the validity or enforceability of the remaining provisions.
SECTION 20 — WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
These Terms and the policies or operating rules published on this website or in connection with the Services constitute the entire agreement between you and TrujilloArt regarding your use of the Services and replace any previous or contemporaneous agreement, communication or proposal on the same subject.
Any ambiguity will be interpreted in accordance with applicable law and will not limit mandatory consumer rights.
SECTION 21 — ASSIGNMENT
You may not delegate, transfer or assign this agreement or any of your rights or obligations under these Terms without our prior written consent. Any attempt to do so will be void to the extent permitted by law.
TrujilloArt may transfer, assign or delegate these Terms and its rights or obligations where necessary to operate the business, provided that such transfer does not reduce your legal consumer rights.
SECTION 22 — GOVERNING LAW AND JURISDICTION
These Terms and any separate agreement under which we provide the Services will be governed by and interpreted in accordance with Spanish law.
Any dispute will be submitted to the courts with jurisdiction under applicable law.
If you are acting as a consumer, this provision does not limit your right to bring proceedings before the courts of your place of residence where required by applicable consumer protection laws.

The headings used in these Terms are provided for convenience only and do not limit or otherwise affect the meaning of any provision.

We reserve the right to update, amend or replace any part of these Terms by publishing an updated version on our website.

Changes will not affect purchases made before they take effect.
